Sole Custody? Sometimes, with the right lawyer
Concluding a three-day child custody trial brought enormous relief recently to a local Alberta parent. Condemning the other parent’s behaviour, a provincial court family Judge directed a child to remain in the Father’s care until further notice. Citing the Divorce Act and child custody case law provided by Calgary family Lawyer Brian Warrington, the Judge praised the Father’s stability, parenting, cooperation, and homestead, citing passages from Mr. Warrington’s legal brief.
“While ultimately the test concerns the best interests of the child, a principal well known to any experienced family lawyer, we made sure of that”, says Warrington.
“Even with the marriage breakdown, the Father is stable, knowledgeable of a three-year old’s diet, hygiene and general well-being. We ensured he was well briefed for trial, that his home was child proofed, and that he is also the friendly parent and has obeyed court Orders”.
Noting that the Mother had not obeyed court Orders, was unstable, had withheld the child, and had demonstrated parent alienating behaviour’s, the family court Judge directed the Mother to undergo counselling, complete parenting courses and to have a period of child supervision before returning to court. The Mother’s counsel declined to comment.
